Attune Terms of Use

Agreement
These Terms of Use ("Terms") are an agreement between you and Nest Studios LLC, a Michigan limited liability company ("Nest Studios," "we," "us"), and govern your use of the Attune app. By downloading or using Attune, you agree to these Terms. If you don't agree, please don't use the app. Your use of Attune is also subject to Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula/); if these Terms conflict with it, Apple's agreement controls as to the license to use the app.
Eligibility
You must be at least 13 years old to use Attune. If you're under 18, or under the age of majority where you live, you may use Attune only with the permission of a parent or guardian, who agrees to these Terms on your behalf.
Not therapy or crisis support
Attune is a tool to support everyday communication between partners. It is not therapy, counseling, medical care, or a crisis service, and it does not diagnose or treat any condition. The relationship "snapshot," pattern insights, goal suggestions, and reframe coach are general, automated prompts, not professional advice. If you are in danger, or someone is hurting, threatening, or controlling you, contact emergency services or a crisis line — in the US, call 911, the National Domestic Violence Hotline at 1-800-799-7233, or the 988 Suicide & Crisis Lifeline.
Subscriptions and billing
Attune is free to download; full access requires an auto-renewing subscription purchased through Apple's App Store. Prices are shown in the app before you buy. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically at the same price and period unless canceled at least 24 hours before the end of the current period. You can manage or cancel anytime in Settings › your name › Subscriptions. If a free trial is offered, any unused portion ends when you purchase a subscription, and you'll be charged when the trial ends unless you cancel at least 24 hours before. All billing, refunds, and cancellations are handled by Apple under its terms; we can't issue refunds directly. To request one, visit reportaproblem.apple.com.
Partner access
When you link with a partner, one active subscription unlocks Attune for both of you. That shared access depends on the subscriber's subscription staying active and the two of you staying linked; it ends if either stops.
Your content and your partner
You own what you write in Attune. Content you choose to share with a linked partner is visible to them, and you're responsible for what you share. Only link with someone you trust. You can unlink at any time; the partner who created the invite deleting the shared space removes shared items for both people.
Acceptable use
Don't use Attune to harass, threaten, monitor, or control another person; to access someone's device or account without permission; or in violation of any law. Don't reverse engineer, interfere with, or misuse the app or Apple's services it relies on.
Automated suggestions
Reframes, goal suggestions, and insights are generated automatically, sometimes by Apple's on-device model. They may be inaccurate, incomplete, or unsuitable for your situation. Use your own judgment before acting on them.
Availability and changes
We may update, change, or discontinue features at any time. Attune relies on Apple services such as iCloud, and we aren't responsible for interruptions to those services. We may update these Terms; if we make material changes we'll update the date above and note it in the app. Continuing to use Attune after changes means you accept them.
Disclaimer of warranties
Attune is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't promise that Attune will improve your relationship or that it will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Nest Studios and its members, managers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, relationships, goodwill, or profits, arising from your use of Attune. Our total liability for any claim relating to Attune will not exceed the greater of the amount you paid for Attune in the 12 months before the claim or US $50. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
Indemnity
You agree to indemnify and hold harmless Nest Studios from claims arising out of your misuse of Attune or your violation of these Terms, to the extent permitted by law.
Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Michigan, and you and we consent to their jurisdiction, except where the law of your place of residence gives you the right to bring a claim locally. Before filing any claim, please contact us at contact@neststudios.app so we can try to resolve it informally.
Apple
These Terms are between you and Nest Studios, not Apple. Apple is not responsible for Attune or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to it (including product liability, legal or regulatory compliance, or intellectual property claims). If Attune fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo or designated as "terrorist supporting," and are not on any US government list of prohibited or restricted parties.
